The Fukushima analogy is uncomfortable — and accurate.

What stood out most is the distinction between scaffolding and control. We are rapidly building AI governance scaffolding (laws, standards, committees), but far fewer organizations are designing mechanisms that can actually sense drift, interpret risk, and intervene in time.

In practice, most AI governance failures I see are not compliance failures — they’re design failures:

Static risk classifications applied to dynamic systems

“Human oversight” without usable control surfaces

Documentation that satisfies audits but cannot drive intervention

AI systems behave like complex adaptive systems, yet many governance approaches still assume bounded, inspectable artifacts. That mismatch is where safety breaks.

In our own work, we’ve been trying to translate this design-first thinking into operational governance mechanisms — inventory that stays current, monitoring that feeds escalation, and controls that evolve as systems change — rather than relying on periodic reviews or post-hoc audits.

Appreciate this piece for naming the problem clearly: we don’t have a regulation gap — we have a design gap.

Excellent framing of the problem. The Fukushima example really drives home how regulations alone can't prevent disaster when the underlying design is flawed. Working on AI systems now, I see the same pattern emerging where compliance checklists become substitutes for actually thinking through failure modes. The gap between having rules and building systems that are fundamentally safe by desgn is underappreciated, and we're probably gonna see more Fukushima-style surprises until that shift happens.
